Internet Terms of Use

AGREEMENT BETWEEN YOU AND SIX CONTINENTS HOTELS, INC. (“SCH”)

All users of SCH’s owned, licensed, managed or franchised hotel Internet services, including but not limited to eHost™, (the "Services") agree to and must comply with this policy. SCH does not exercise editorial control or review over the content of any Web site, electronic mail transmission, newsgroup or other material created or accessible over or through the Services. However, SCH may remove, block, filter or restrict by any other means any materials that, in SCH's sole discretion, may be illegal, may subject SCH to liability or which may violate this policy. SCH may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. Violation of this policy may result in the suspension or termination of either access to the Services and/or other actions. This policy should be read in conjunction with SCH’s other policies, all of which are posted on our website at www.ihg.com.

USE OF THE SERVICE AND ACCESS TO THE WEB SITE

The Service is provided solely for you to make legitimate, personal noncommercial use of the Internet and for no other purposes. You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to use the Service in accordance with all terms and conditions herein. You agree to be financially responsible for all of your use (as well as for authorized use of your account by others). You agree to supervise all usage by minors of this Service site under your name or account. You also warrant that all information supplied by you in using this Service is true and accurate. You shall be completely responsible for all charges, fees, duties, taxes and assessments arising out of the use of this Service or accessing any Web site by way of the Service.

VIOLATIONS OF THE POLICY

The following represents violations of the SCH Internet Use Policy and is not all inclusive but representative:

Illegal use: Using the Services to transmit any material (by email, uploading, posting or otherwise) that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations promulgated thereunder.
Harm to minors: Using the Services to harm, or attempt to harm, minors in any way.
Threats: Using the Services to transmit any material (by email, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.
Harassment: Using the Services to transmit any material (by email, uploading, posting or otherwise) that harasses another.
Fraudulent activity: Using the Services to make fraudulent offers to sell or buy products, items or services or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes", unregistered sales of securities, securities fraud and "chain letters."
Forgery or impersonation: Adding, removing or modifying identifying network, message or article header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited.
Unsolicited commercial email/unsolicited bulk email: Using the Services to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email, whether or not that email is commercial in nature, are prohibited. Using deliberately misleading headers in emails sent to multiple parties is prohibited.
Unauthorized access: Using the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of SCH's or another entity's computer software or hardware, electronic communications system or telecommunications system, whether or not the intrusion results in disruption of service or the corruption or loss of data.
Copyright or trademark infringement: Using the Services to transmit any material (by email, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights SCH or of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
Collection of personal data: Using the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
Reselling the Services: Reselling the Services without SCH's authorization.
Network disruptions: Using the Services for any activity that adversely affects the ability of other people or systems to use SCH Services or the Internet. This includes excessive consumption of network or system resources whether intentional or unintentional. This also includes "denial of service" attacks against another network host or individual user. Interference with or disruption of other network users, network services or network equipment is prohibited. It is your responsibility to ensure that your system is configured, operated and used in a manner to avoid excessive consumption of network or system resources. It is also your responsibility to ensure that your system is configured in a secure manner.
News: SCH users should use their best judgment when posting to any newsgroup. Many newsgroups have charters, published guidelines, FAQs or "community standards" describing what is and is not considered appropriate.
High Volume. High-volume data transfers, especially sustained high-volume data transfers, are prohibited.

SECURITY OF ACCESS AND USE

Due to the nature of wireless LAN and High-Speed Internet Access networks, control of physical access to the network cannot be ensured. In the case of wireless networks, unlike a wired network where a physical connection is required, anyone within range of a wireless access point can conceivably send and receive frames as well as listen for other frames being sent, making eavesdropping and remote sniffing of wireless LAN frames very easy. In addition, under certain circumstances, third parties could access your computer without your permission while it is connected to the network.

OWNERSHIP OF SOFTWARE

You acknowledge and agree that title and/or license rights to any and all software programs used to provide the Service (“Software”) is the property of the Six Continents Hotels, Inc. and its third-party suppliers, and is the subject of intellectual property rights, including, without limitation, patents, copyrights, trademarks and trade secrets. Six Continents Hotels, Inc. and its third-party suppliers expressly reserve all right, title and interest with respect to the Software and all intellectual property rights therein. You may not access or use the Software except as provided to you by the local network, only in the normal course of your personal use of the Services in accordance with this Internet Use Policy, and only during such period as you use the Services while present on the hotel property. You may not reproduce, redistribute, publish or otherwise transfer or commercially exploit any of the Software, and shall not attempt to access, copy, use, reverse engineer, decompile or disassemble, modify or adapt any Software.

THESE SERVICES AND THE MATERIALS FOUND ON THIS WEBSITE ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY, REPRESENTATION, CONDITION, UNDERTAKING OR TERM OF ANY KIND, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR FITNESS FOR A PARTICULAR PURPOSE. The Services are being provided by SCH and its third-party supplier. Internet Services such as e-Host provide web page content and links to hotel services and other businesses that may be of interest to you during your hotel stay. As you are linked to various companies offering goods and services, the individual privacy policies of each company will govern the collection and use of any personally identifiable information you may choose to provide.

GENERAL

Any claim relating to this Agreement, the Materials or the Service shall by governed by the laws of the State of Georgia, United States of America, exclusive of the choice of law rules thereof. This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof and supersedes all prior oral and written agreements. No failure or delay on the part of SCH in exercising any right or remedy hereunder or enforcing the terms and conditions of this Agreement will operate as a waiver thereof. If any part or provision of this Agreement is found to be invalid, unenforceable or void, then the remaining portion shall remain in full force and effect. Headings are for convenience only and not for use in interpretation of this Agreement.
You agree that no joint venture, partnership, employment or agency relationship exists between you and SCH as a result of this agreement or use of the Service.
Fictitious names of companies, products, people, characters and/or data mentioned herein are not intended to represent any real individual, company, product or event.
